TERMS AND CONDITIONS OF SERVICE
For the OUR-SCHOOL E-Learning Platform

Welcome to OUR-SCHOOL (“the Platform”), an online learning system owned and operated as a division of The Global Merchant Pty Ltd (“the Company”, “we”, “us”, “our”).
These Terms and Conditions (“Terms”) govern your access to and use of the OUR-SCHOOL platform, website, and services. By registering an account as an Instructor, Parent, or Legal Guardian, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.
SECTION A: GENERAL TERMS FOR ALL USERS
 
1. Platform Overview
OUR-SCHOOL provides an educational platform hosting CAPS-aligned curriculum courses spanning Grade R through Grade 12. The Platform connects independent Instructors with Parents/Guardians seeking educational content for learners.
2. Account Registration and Security
  • Accuracy: You agree to provide accurate, current, and complete information during registration and keep your account details updated.
  • Security: You are entirely responsible for maintaining the confidentiality of your account password. You agree to notify us immediately at admin@our-school.co.za if you suspect unauthorized access.
  • Account Transfer: Accounts are personal and non-transferable.
3. Acceptable Use Policy
All users agree not to use the Platform to:
  • Violate any local South African or international laws.
  • Post, upload, or transmit any content that is defamatory, abusive, offensive, or infringes on intellectual property rights.
  • Introduce viruses, trojans, worms, or other malicious software.
  • Scrape, data-mine, or harvest user data from the Platform without authorization.
4. Intellectual Property
  • Platform Content: The OUR-SCHOOL name, logo, website design, graphics, coding, and platform features are the exclusive property of The Global Merchant Pty Ltd.
  • Restrictions: Users may not copy, modify, distribute, sell, or lease any part of our Platform or included software without prior written consent.
5. Limitation of Liability
To the maximum extent permitted by South African law (including the Consumer Protection Act, No. 68 of 2008):
  • OUR-SCHOOL is provided on an “as-is” and “as-available” basis.
  • The Global Merchant Pty Ltd shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Platform, course interruptions, or data loss.
SECTION B: TERMS FOR PARENTS AND GUARDIANS
 
1. Eligibility and Children’s Accounts
  • Minors: Learners under the age of 18 are not permitted to register accounts independently.
  • Guardian Setup: A parent or legal guardian must create the primary account and add student profiles under their direct authorization and supervision.
  • Responsibility: By enrolling a learner, you affirm that you are the legal parent or guardian and accept full financial and behavioral responsibility for the student profiles linked to your account.
2. Fees, Billing, and Payfast Payments
  • Course Purchases: Access to premium CAPS course collections requires payment of the specified fees.
  • Payment Gateway: All monetary transactions are processed securely through Payfast. You agree to abide by Payfast’s terms of service during checkout.
  • Pricing: We reserve the right to alter course prices at any time. Price adjustments will not affect already purchased, active course subscriptions.
3. Refund Policy
  • Due to the immediate digital delivery of educational content, refund requests are evaluated on a case-by-case basis.
  • To request a refund due to billing errors or technical platform faults, you must contact support within 7 days of purchase at admin@our-school.co.za.
SECTION C: TERMS FOR INSTRUCTORS
 
1. Instructor Eligibility & Profiles
  • Verification: Instructors must provide valid credentials, proof of qualifications, or background checks upon request to maintain platform integrity.
  • Profile Presentation: Instructors are responsible for their profile content, including profile cover banners, descriptions, and introductory materials. Profile images must remain professional and age-appropriate for a K-12 environment.
2. Course Content Ownership and Licensing
  • Your Content: Instructors retain ownership of the original text, videos, and worksheets they author and upload to the Platform.
  • License to Platform: By uploading curriculum content, you grant OUR-SCHOOL a non-exclusive, worldwide, royalty-free license to host, display, stream, and distribute your material to enrolled students.
  • CAPS Alignment: Instructors targeting South African learners must ensure their courses reasonably align with national CAPS milestones for the advertised grade level.
3. Professional Conduct and Child Safety
  • Direct Interaction: Instructors must maintain strictly professional communication with learners and parents via official platform channels. Direct, unmonitored communication outside the platform with minors is strictly prohibited.
  • Reporting: Instructors are mandated to report any suspicious activity, cyberbullying, or safety concerns regarding learners immediately to the platform administration.
SECTION D: AMENDMENTS AND DISPUTES
 
1. Modifications to Terms
We reserve the right to update or replace these Terms at any time. When changes occur, we will update the “Last Updated” date at the top of this document. Continued use of the platform after updates indicates absolute acceptance of the revised Terms.
2. Termination of Accounts
We reserve the right to suspend or permanently terminate your account (whether parent, student, or instructor) without prior notice if you breach these Terms, engage in fraudulent activity, or compromise the safety of our online school community.
3. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in South Africa.
